Terms of Use

1. Agreement

By downloading or using Fireplace Live Wallpaper ("the App"), you agree to these Terms of Use. The App is licensed — not sold — to you under the terms of the Apple Standard EULA, which forms the base of this agreement. These Terms add to, and do not replace, the Apple Standard EULA.

2. License

Subject to your compliance with these Terms and the Apple Standard EULA, you are granted a limited, non-exclusive, non-transferable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Mac App Store Usage Rules.

3. Ownership of Content

The App includes original fireplace video recordings, audio, artwork, and design (collectively, "Content"). The Content is owned by us or our licensors and is protected by copyright and other intellectual property laws.

4. Restrictions

You agree not to:

• Extract, copy, download, record, redistribute, or republish the video or audio Content included in the App, in whole or in part
• Use the Content as source material for other apps, videos, compilations, or AI/ML training datasets
• Modify, reverse-engineer, decompile, or attempt to derive the source code of the App
• Resell, sublicense, rent, or lease the App to anyone else
• Use the App in any way that violates applicable law

5. Acceptable Use of Features

The App sets a live wallpaper and screensaver on your Mac. You are responsible for adjusting the App's settings (including screensaver timing and sound) so that its behavior is appropriate for your environment and usage.

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or free of battery or performance impact. Display of video on OLED or other display types may, as with any prolonged static or looping content, carry inherent display considerations; you use the wallpaper features at your own discretion.

7. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the App is limited to the amount you paid for the App. We are not liable for indirect, incidental, special, consequential, or punitive damages.

8. Changes

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms.
